with what firmware on the Hayes (K56Flex/V.90)? version?
was this modem originally K56Flex then upgraded to V.90??

are you using the V.90 code in your max or a K56Flex one?

one of the down sides to V.90 is that the decisions
of how to build the PCM constellations can be very different
for two modems under the same line conditions, so the "white-box"
or "clone" modems may actually do better on a really clean line, 
but I'd bet that Hayes will do better on a noisy one, 
but this WILL vary based on other random differences.
